It addressed how a violation of the existing requirement could be handled during roadside enforcement.

What FMCSA proposed

FMCSA published the proposal on August 10, 2026. It would codify the English-language proficiency requirement in 49 CFR 391.11(b)(2) as an out-of-service violation and align the federal regulation with the North American Standard Out-of-Service Criteria.

The proposal included a limited exception for certain Mexico-domiciled drivers whose current trip remains inside U.S.-Mexico border commercial zones. FMCSA stated that the change would not create a new reporting or recordkeeping requirement.

Status at the end of August

As of August 31, this action remained a proposed rule. Carriers should not describe it as a final new regulation or assume the proposal’s language and timing cannot change.

Why it matters to a small carrier

An out-of-service decision can interrupt a load immediately. That can lead to missed appointments, lost revenue, added lodging or transportation costs, and customer-service problems. For a one-truck business, one stopped trip can affect the entire week.

What carriers can do

Review the existing driver qualification with every driver.

Make sure drivers can communicate with an officer during an inspection.

Confirm drivers can understand English highway signs and signals.

Follow the Federal Register docket for any final rule and effective date.

Use qualified legal or compliance guidance for a specific driver or operation.

The qualification already existed in August 2026. The proposal concerned more uniform out-of-service enforcement.

How Capital Depot can help

Review driver qualifications before dispatch rather than discovering a problem at roadside.
